小王遭毆不治 男依傷害致死罪判8年

新竹一名王姓男子懷疑妻子與樂姓男子有曖昧，找親友前往樂姓男子家中理論，不料，竟在對方父母面前將樂姓男子痛毆致死。全案經過法院審理，雖然被害家屬認為，有下跪求情但兒子還是被活活打死，被告根本就是殺人，不過，高院認為，王姓男子並沒有殺人意圖，依傷害致死罪判處八年有期徒刑。

王姓男子是去年八月，發現妻子和樂姓男子LINE通訊軟體有曖昧對話，他懷疑妻子有婚外情，一起找了親友到對方家中興師問罪，王姓男子搶了樂姓男子的手機，確認有曖昧對話紀錄之後，一時氣憤痛毆對方，親友也幫忙動手，雖然被害人父母曾經下跪求情，不過，樂姓男子最後仍傷重不治。

全案經過法院審理，雖然被害家屬指控被告的行為是殺人，不過，法院認為，王姓男子攻擊對方，沒有查看傷勢，而且有意將死者帶去和妻子對質，應該只是低估死者傷勢，並非故意殺人，因此，高院二審認同一審判決，依傷害致死罪判處王姓男子8年有期徒刑，至於，兩名親友，則是分別被判處7年10個月和1年9個月刑期。
